These Terms & Conditions ("**Terms**") govern the use of the Captain Suite website at **[https://captain-suite.com/](https://captain-suite.com/)** (the "**Website**") and bookings made for accommodation at Captain Suite.

By making a booking, you confirm that you have read, understood and agree to these Terms.

## 2. Definitions

For these Terms:

* "**Captain Suite**", "**we**", "**us**" or "**our**" means A.S ELA TOURISM TECHNOLOGIES LTD and/or the operator of Captain Suite.
* "**Guest**", "**you**" or "**your**" means the person making a booking and any other person staying at the accommodation under that booking.
* "**Accommodation**" means Captain Suite and the facilities made available to the Guest as part of the booking.
* "**Booking**" means a confirmed reservation for the Accommodation.
* "**Website**" means [https://captain-suite.com/](https://captain-suite.com/) and any related pages operated by us.

## 3. Booking eligibility

Bookings may only be made by persons who are legally capable of entering into a binding contract.

The person making the Booking is responsible for:

* providing accurate and complete information;
* ensuring that all Guests comply with these Terms;
* ensuring that the number and identity of Guests correspond to the Booking;
* ensuring that all Guests comply with applicable laws and property rules.

We reserve the right to request reasonable identification or other information necessary to verify a Booking or comply with legal obligations.

## 4. Making a booking

A Booking request does not become a confirmed reservation until we have accepted the Booking and, where applicable, received the required payment or deposit.

After confirmation, we may provide you with a booking confirmation containing information such as:

* Guest name;
* dates of stay;
* number of Guests;
* total price;
* payment information;
* check-in instructions;
* access information.

Please check your confirmation carefully and notify us promptly if any information is incorrect.

## 5. Prices and payment

The total price of the Accommodation will be displayed or communicated to you before you confirm your Booking.

Depending on the Booking method, payment may be made by one of the payment methods we make available, which may include:

* Stripe;
* PayPal;
* bank transfer; or
* another payment method expressly offered at the time of Booking.

Any applicable taxes, fees or charges will be communicated to you before or at the time the Booking is confirmed, to the extent required by applicable law.

A Booking may be cancelled or refused where the required payment is not received within the applicable payment deadline.

## 6. Cancellation by the Guest

Unless a different cancellation policy is expressly stated in your Booking confirmation, the following policy applies to direct bookings:

### Free cancellation

You may cancel your Booking without a cancellation charge if you cancel at least **[X days] before the scheduled check-in date**.

The applicable cancellation deadline is calculated by reference to the scheduled arrival date and local time at the Accommodation.

Where a Booking is cancelled within the free-cancellation period, payments already received will be refunded in accordance with the payment method used, subject to any non-refundable third-party charges that were clearly disclosed before the Booking was made.

### Late cancellation

If you cancel less than **[X days before arrival]**, the Booking may be subject to a cancellation charge of **[insert applicable charge]**.

### No-show

If you do not arrive on the scheduled check-in date without having cancelled your Booking, the Booking may be treated as a no-show and the applicable cancellation/no-show charge may apply.

Where a Guest expects to arrive late, the Guest should contact us in advance.

### How to cancel

Cancellations should be made through the booking channel used to make the reservation or by contacting us using the contact details provided in your Booking confirmation.

Where a cancellation is made by email or another communication method, cancellation is effective when we have received and acknowledged the request, unless applicable law or the Booking terms provide otherwise.

## 7. Changes to a booking

Requests to change a Booking, including changes to:

* dates;
* number of Guests;
* arrival or departure time; or
* other material booking details

are subject to availability and our acceptance.

A change may result in a change to the price.

We will inform you of any additional charge or refund before confirming a material change where reasonably practicable.

## 8. Check-in and check-out

The standard check-in and check-out times are those stated on the Website and/or in your Booking confirmation.

Unless otherwise agreed:

* **Check-in:** from **15:00**
* **Check-out:** by **11:00**

Early check-in and late check-out are not guaranteed and may be subject to availability and/or an additional charge.

Guests must leave the Accommodation by the applicable check-out time unless a later departure has been expressly agreed.

## 9. Self check-in and electronic access

Captain Suite may use electronic access technology, including **Nuki smart-lock technology**, to provide Guests with access to the Accommodation.

Guests must:

* keep access codes, links, keys or credentials confidential;
* not share access credentials with unauthorised persons;
* use the access system only for the purposes of their Booking;
* notify us promptly if an access credential is lost, compromised or appears to have been used by someone else.

Access credentials may be activated only for the applicable Booking period.

We may deactivate or change access credentials where reasonably necessary for security, operational or legal reasons.

## 10. Number of Guests

Only the number of Guests stated in the Booking may stay at the Accommodation unless we have expressly agreed otherwise.

Guests must not exceed the maximum occupancy permitted for the Accommodation.

Visitors who are not included in the Booking may only enter or stay at the Accommodation with our prior permission where required by the property rules.

We may require unauthorised additional Guests to leave the Accommodation and may charge reasonable additional accommodation costs where appropriate and permitted by law.

## 11. Use of the Accommodation

The Accommodation must be used solely for temporary residential accommodation.

Guests must not use the Accommodation:

* for unlawful purposes;
* for commercial activities without prior written permission;
* for parties or events;
* for activities that cause unreasonable disturbance;
* for activities that create a safety, fire or security risk;
* in a manner that could damage the property or its contents.

The Guest is responsible for the conduct of all persons staying at or visiting the Accommodation.

## 12. Parties, events and excessive noise

Parties, celebrations, events and other gatherings are not permitted unless expressly authorised by us in advance.

Guests must respect neighbours and the residential nature of the property.

Excessive noise, disruptive behaviour, shouting, loud music or other conduct that unreasonably disturbs neighbours is prohibited.

Where we reasonably believe that a Guest is causing a serious disturbance or creating a safety or security risk, we may require the Guest to cease the conduct immediately and, where necessary and legally permitted, terminate the stay.

## 13. Smoking

Smoking is not permitted inside the Accommodation unless expressly stated otherwise in the Booking information.

This includes cigarettes, cigars, pipes, vaping devices and other smoking or vapor-producing products where prohibited by the property rules or applicable law.

Guests are responsible for any damage, cleaning costs, odours or other losses resulting from smoking in prohibited areas, subject to applicable law.

## 14. Pets

Pets are permitted only where expressly agreed in advance.

Guests must not bring an animal into the Accommodation without prior approval.

Where pets are permitted, the Guest is responsible for ensuring that the animal does not cause damage, excessive noise, nuisance or hygiene problems.

Any additional pet-related terms or charges communicated at the time of Booking will apply.

## 15. Care of the property

Guests must take reasonable care of the Accommodation, furniture, appliances, fixtures, fittings, keys, access devices and other property.

Guests must:

* keep the Accommodation reasonably clean and tidy;
* use appliances and facilities appropriately;
* not move or remove furniture or property without permission;
* not tamper with safety equipment or security systems;
* report damage, defects or maintenance problems promptly.

Guests must not undertake repairs or modifications themselves without our permission, except where immediate action is reasonably necessary to prevent imminent harm.

## 16. Damage and additional costs

The Guest may be responsible for reasonable costs arising from:

* damage caused by the Guest or members of their party;
* loss of keys, access devices or other property;
* missing items;
* exceptional cleaning required because of misuse;
* unauthorised smoking;
* unauthorised additional Guests;
* other breaches of these Terms that cause us reasonably incurred loss.

We will not impose unreasonable or punitive charges.

Where we seek payment for damage or other costs, we will provide reasonable information about the basis of the charge upon request.

Nothing in this section limits any rights you may have under applicable consumer law.

## 17. Parking

Parking availability and any applicable parking charges are as stated on the Website or in the Booking information.

Where parking is available, use of a parking space is subject to availability and any applicable restrictions.

Guests are responsible for complying with parking regulations and for ensuring that their vehicle is appropriately parked.

Unless required by law, we are not responsible for loss of or damage to vehicles or their contents.

## 18. Personal belongings

Guests are responsible for their personal belongings during their stay.

We recommend that valuable items are not left unattended.

Where safe-deposit or other secure-storage facilities are provided, their use is subject to any specific instructions supplied with the facility.

To the extent permitted by law, we are not responsible for loss, theft or damage to personal belongings unless caused by our negligence, wilful misconduct or another circumstance for which we are legally responsible.

## 19. Safety and security

Guests must comply with all safety instructions provided at the Accommodation.

Guests must not:

* obstruct emergency exits;
* disable smoke detectors or other safety equipment;
* interfere with security systems;
* use appliances in an unsafe manner;
* store dangerous or unlawful substances at the Accommodation.

Guests should notify us immediately of any safety, security or maintenance issue that could cause injury or property damage.

## 20. Video doorbell and security systems

For security purposes, a video doorbell may operate at the main entrance to the property.

The system is intended to protect the property, Guests and visitors and may record or process images and/or other information in accordance with our Privacy Policy and applicable data-protection law.

Guests must not tamper with, disable, obstruct or interfere with security or access-control equipment.

Further information about the processing of personal data is provided in our **Privacy Policy**.

## 21. Maintenance and access by the operator

We will make reasonable efforts to ensure that the Accommodation and its facilities are available and in good working order.

Occasionally, maintenance, repairs, inspections or emergency works may be necessary.

We may enter the Accommodation where reasonably necessary for:

* an emergency;
* urgent repairs;
* maintenance;
* safety or security reasons;
* inspection following a reported problem; or
* another legitimate reason permitted by law.

Except in an emergency, we will make reasonable efforts to provide advance notice where practicable.

## 22. Facilities and temporary interruptions

Descriptions, photographs and information on the Website are intended to provide an accurate representation of the Accommodation.

Facilities, appliances, internet access, utilities or other services may occasionally be unavailable because of:

* maintenance;
* technical failure;
* utility interruption;
* circumstances outside our reasonable control; or
* other unforeseen circumstances.

We will make reasonable efforts to restore affected services as soon as reasonably practicable.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

## 23. Internet and Wi-Fi

Where Wi-Fi or internet access is provided, it is provided primarily as an accommodation facility and may be subject to availability and technical limitations.

Guests must not use the internet connection:

* unlawfully;
* to infringe intellectual-property rights;
* to distribute malicious software;
* to access or distribute unlawful content;
* to attack or interfere with networks or systems; or
* for any activity that could expose us or third parties to liability.

The Guest is responsible for the use of the internet connection by members of their party.

## 24. Accessibility and special requirements

Guests with accessibility requirements or other specific needs should contact us before Booking so that we can provide accurate information about the Accommodation and determine whether the property can meet their requirements.

We will make reasonable efforts to provide accurate information about accessibility features, but Guests should not assume that the Accommodation is suitable for a particular requirement without confirmation.

## 25. Complaints and problems during a stay

If you experience a problem with the Accommodation, please notify us as soon as reasonably possible.

We will have a reasonable opportunity to investigate and, where appropriate, remedy the problem during your stay.

If a problem is not reported until after departure, it may be more difficult for us to investigate or remedy it.

Nothing in this section limits any mandatory rights you have under applicable consumer-protection law.

## 26. Our liability

We are responsible for losses and damage where and to the extent required by applicable law.

Nothing in these Terms excludes or limits liability for:

* death or personal injury caused by negligence where such liability cannot lawfully be excluded;
* fraud or fraudulent misrepresentation;
* intentional misconduct;
* any other liability that cannot legally be excluded or limited.

Subject to the above, we will not be responsible for losses that:

* were not reasonably foreseeable when the Booking was made;
* are caused by circumstances outside our reasonable control; or
* result from the Guest's breach of these Terms or negligent or unlawful conduct.

Mandatory consumer rights remain unaffected.

## 27. Circumstances outside our control

We will not be liable for failure or delay in performing our obligations where this results from circumstances beyond our reasonable control.

Such circumstances may include, where applicable:

* natural disasters;
* extreme weather;
* fire;
* flood;
* serious utility failure;
* epidemic or pandemic restrictions;
* war or terrorism;
* civil unrest;
* government action;
* strikes or industrial disputes;
* major infrastructure or telecommunications failures; or
* other events that could not reasonably have been prevented or overcome.

Where such circumstances materially affect a Booking, we will communicate with the Guest and take reasonable steps to minimise the impact.

## 28. Cancellation or termination by us

We may cancel a Booking or terminate a stay where reasonably necessary and legally permitted, including where:

* the Guest has provided materially false or misleading information;
* payment is not made when due;
* the Accommodation is used unlawfully;
* the Guest seriously breaches these Terms;
* the Guest causes serious damage or creates a serious safety or security risk;
* the Guest seriously disturbs neighbours or other occupants; or
* the Accommodation becomes unavailable due to circumstances outside our reasonable control.

Where we cancel a Booking for reasons attributable to us before the stay begins, we will provide any refund or other remedy required by applicable law.

Where a stay is terminated because of a serious breach by the Guest, any refund will be determined in accordance with applicable law and the circumstances of the termination.

## 29. If we need to change or cancel your Booking

Although we make reasonable efforts to honour confirmed Bookings, circumstances may arise in which the Accommodation becomes unavailable.

If we must cancel a confirmed Booking for reasons not caused by the Guest, we will notify the Guest as soon as reasonably practicable and, where appropriate, offer:

* alternative accommodation;
* alternative dates; or
* a refund of amounts paid for the affected Booking.

The Guest's mandatory statutory rights remain unaffected.

## 30. Privacy and personal data

Personal data is processed in accordance with our **Privacy Policy** and applicable data-protection legislation, including the EU General Data Protection Regulation (GDPR).

The Privacy Policy explains:

* what personal data we collect;
* why we process it;
* our legal bases for processing;
* third parties with whom information may be shared;
* retention periods; and
* your data-protection rights.

## 31. Website content

We make reasonable efforts to ensure that information published on the Website is accurate and up to date.

However, photographs, descriptions, availability, prices, facilities and other information may occasionally change.

The availability and price applicable to a Booking are those confirmed to the Guest at the time the Booking is accepted.

We reserve the right to correct obvious errors in Website content or pricing, subject to applicable law.

Unless otherwise stated, the Website and its content, including text, photographs, graphics, logos, branding, design and other materials, are owned by or licensed to us.

You may access and use the Website for personal, non-commercial purposes.

You must not reproduce, distribute, modify, publish, sell or commercially exploit Website content without our prior written permission, except where permitted by law.

## 35. Governing law

These Terms are governed by the laws applicable to the contractual relationship, subject to any mandatory consumer-protection provisions that apply to you.

Where mandatory consumer-protection legislation grants you the right to rely on the laws or courts of your country of residence, nothing in these Terms is intended to remove or restrict that right.

## 36. Disputes

We encourage Guests to contact us first so that we can attempt to resolve any complaint or dispute informally.

Nothing in these Terms prevents a consumer from exercising any mandatory right to bring proceedings before a competent court or to use an applicable alternative dispute-resolution mechanism.

## 37. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be modified or interpreted to the minimum extent necessary to make it valid and enforceable.

The remaining provisions will continue in full force and effect.

The version applicable to your Booking will generally be the version in force when your Booking was confirmed, unless a change is required by law or is otherwise permitted to apply to an existing Booking.

### Cancellation policy to be completed

Before publishing these Terms, replace the following placeholders in Section 6:

* **[30 days before arrival]** — the number of days before check-in when free cancellation ends.
* **[100% penalty] — the charge applicable after the free-cancellation deadline.

For example, if your intended rule is "free cancellation up to 30 days before arrival; 100% charge thereafter".

**Important legal point:** For an EU accommodation business, a blanket statement such as “Cyprus law applies and only Cyprus courts have jurisdiction” can be problematic for consumers in other EU countries. The final version should be reviewed against the exact way Captain Suite contracts with guests, particularly because the operator and accommodation are in different countries.

Also, the **[30 days]** cancellation placeholders need to be filled in before publication.
